Paul Whittle Mediation Fee’s and Terms of Business

 

Paul welcomes initial contact by email or telephone and will be pleased to discuss cases and fees. Fees are negotiable so please contact Paul to discuss your requirements, and he will do his very best to meet your needs.

 

It is Paul’s aim to provide the best service which is both cost effective and proportional to the dispute. Paul's fees are fixed and include travelling with the UK.

 

Below are guidelines which indicate the basic rate which Paul will provide his mediation services for where monetary sums are claimed or counterclaimed.

 

If it is the case that the dispute does not primarily contain monetary sums, there will be an hourly or daily rate agreed with Paul.

Please note that some claims have lower monetary values but are highly complex and require increased levels of prepartion. In these cases increased sums will need to be discussed.

The fees are assumed to be charged equally between the parties each being charged 50% of the day fee unless Paul is instructed otherwise.

 

Where parties are represented by solicitors, the invoice will be addressed to those solicitors; they must agree to accept liability for the agreed charges and expenses.

 

A final balancing invoice or credit note, if applicable, will be issued and become payable immediately following the mediation.

 

Interest will be charged on amounts overdue at the rate of 15% pa.

 

Time

 

The fees above include 4 hours preparation time prior to the mediation. Time required for preparation over 4 hours will be charged at £125.00 per hour.

 

The fee assumes a 10 hour day after which with the agreement of all parties the hourly rate is charged at £125.00 per hour. Please be aware that Paul is a great believer in settling the dispute within normal working hours.

 

Expenses

 

The fees above include travelling costs within the UK. Travelling and accomodation for international mediations will be charged at a cost only basis.

 

Accommodation may be charged if the mediation continues past 10pm.

 

Paul is not liable for any venue, catering or stationary costs.

 

If the parties can not make their own venue arrangements, suitable venue’s can be suggested/arranged by Paul but have to be settled by the parties directly.

 

Cancellations

 

Any cancellation or postponements made before 10 days of the commencement of the mediation will not incur any charge.

Any postponements made within 2 days of the mediation and then rearranged will incur 50% of the daily fee plus the full fee for the new mediation date.
